Licensing Regulations ~ Article 25
Prerequisites for the acquisition
of a License
A stallion can only acquire a license when it satisfies the
prerequisites for an entry in the Stallion Book I (article
12, SBR).
The Canadian Oberlander Horse Association can impose
higher requirements which are to be specified by the advisory
council.
The committee of judges may prolong the deadlines by no more
than 15 months in individual cases due to special circumstances.
If the deadlines determined are not kept, the stallion is
considered as not entered and not licensed.
Admission to the Licensing Proceedings
- The owner of the stallion is to be
a member of the association
- The dates of the licensing events and
the method of execution are determined by the Canadian Oberlander
Horse Association.
- The licensing of a stallion is to be
applied for at the office of the association.
- The following conditions are
to be satisfied
for the acquisition of the admittance of a stallion to the
licensing event:
- The minimum age is two years
- The stallion is to be presented
in advance if a
pre-selection is to be carried out before the licensing
event.
- The descent is to satisfy the conditions
for an entry in the Stallion Book I.
- The account of descent is to be
presented.
- The mothers of the stallions must
have passed a performance test. The committee of judges
is to decide on exceptions.
- The identity of the stallion is
to be examined based on the account of descent before
the licensing proceedings.
- Stallions lacking a sufficient
identification are to be excluded from the licensing
event.
- As a further required document
for securing the identity an account of the submission
of a DNA record or the results of the examination of
other features for securing of the identity of the parents
are to be presented
- An important prerequisite
for the admittance to licensing and for the licensing
event itself is that the stallion has no defects in
the state health to affect the ability to breed and
the breeding value. Defects of the health are among
others:
- An impairment of the sexual
organs, justifying
considerable objections against a use of the stallion
in breeding.
- Signs justifying the assumption
of a hereditary disposition to diseases.
- Operations for the purpose
of correcting deficiencies of the body.
Execution
To assure orderly licensing events, the procedures are laid
down in advance. The licensing event comprises at least two
examinations, one of which is to take place on firm ground.
Free running may be demanded.
The decision on the grant of a license may be:
- licensed
- not licensed
- preliminary not licensed
The decision on the grant of a license
shall be "preliminarily not licensed" when the stallion
does not satisfy the requirements with respect to the exterior
and/or the usefulness for breeding, it is, however, to be
expected that it will satisfy those requirements in the future.
Upon this decision concerning the license a deadline is to
be determined upon the expiration of which the stallion can
again be presented for the purpose of acquiring a license.
The decision on the grant of a license
is to be published and to be communicated to the owner of
the stallion in writting. The decision "Licensed"
is to be entered into the account of descent, if necessary
including a deadline for the participation in a stallion performance
test.
Regulations on Medication Control
Stallions to which a doping substance or a drug prohibited
according to the execution regulations associated with
article 9.2 of the Regulations on Breeding Association (Appendix
5) have been administered or which have been operated
or manipulated with the intention of influencing the performance,
the efficiency or the serviceability are not admitted to the
pre-selection / the licensing event, irrespective of the person
responsible. The committee of judges is entitled to demand
medication controls as random tests.
Withdrawal, Revocation, Protest
The license is to be withdrawn by the breeding association
if a prerequisite for its bestowal has not been fulfilled.
A license is to be revoked by the association if one of the
prerequisites has subsequently been rendered invalid. It can
be revoked by the association if a requirement is associated
with it and the benefactor has not fulfilled the same or has
not fulfilled it in due time. The owner of the stallion can
protest against the decision on the grant of a license. The
protest is to be justified in writting. The deadline for a
protest is four weeks after the reception of the written decision
on the grant of a license. The protest commission decides
on the acceptance of the protest. If the protest its accepted,
the same commission decides in due course on the place and
date of the renewed presentation of the stallion and on the
composition of the committee of judges, all members of which,
with the exception of the stock supervisor, are newly appointed.
Protests have no suppressive effect. No
right of recourse may be derived from the decisions of the
stallion Book Commission.
